Biden’s Justice Department just filed a lawsuit against Texas Governor Greg Abbott over his effort to defend the border

Texas Governor Greg Abbott is doing the bare minimum to try and stem the tide of illegal aliens crossing the border.

But even that is too much for Joe Biden.

And Biden’s Justice Department just filed a lawsuit against Texas Governor Greg Abbott over his effort to defend the border.

The Biden Department of Justice filed a lawsuit against Texas and its Republican Governor for attempting to try and slow down or end the flood of illegal aliens into the United States.

Ready to take it to the Supreme Court

Not only is the Biden administration unwilling to secure the border, but apparently they are also dead set against anyone else trying to do it.

This has led to the worst illegal immigration problem in American history.

But instead of following the Constitution, the Biden administration is doing all it can to stop anyone from trying to secure the border.

The Justice Department claims that the marine floating barriers Texas officials put up in the Rio Grande are unauthorized and in violation of federal law.

Texas Republican Governor Greg Abbott responded by indicating that he’s willing to take this fight all the way to the Supreme Court. 

He sent a letter to Joe Biden that said, “Texas will see you in court, Mr. President.”

The lawsuit is in response to Operation Lone Star, which is a plan where Texas committed to installing marine floating barriers in the Rio Grande to try and discourage illegal aliens from crossing the river.

The 1,000-foot floating barrier is made up of a series of interconnected inflatable buoys that are four feet wide and can be moved and extended. 

When the buoys are grabbed by people trying to ford the river, the buoys spin, preventing anyone from climbing over them.

Although they are not fool-proof, the buoys are a clear deterrent.

Violating an 1899 law?

Abbott said in a statement that the Texas Department of Public Safety oversaw the installation of these buoys in an area called Eagle Pass on July 7.

Eagle Pass was selected because it is a heavily trafficked entry point into the country for illegal aliens.

According to Texas DPS Director Steve McCraw, the initial phase of the buoy deployment has so far cost Texas just over $1 million.

But the Biden administration will not allow Texas to proceed without a fight. 

Todd Kim, the Assistant Attorney General for the Justice Department’s Environment and Natural Resources Division, filed the lawsuit in the U.S. District Court for the Western District of Texas.

The lawsuit does not directly challenge Texas trying to stop the flow of illegal aliens but instead claims that the barrier obstructs navigable American waters in violation of the Rivers and Harbors Act of 1899. 

The suit also claims such structures cannot be placed in the Rio Grande without prior approval from the U.S. Army Corps of Engineers. 

According to the Justice Department, Texas did not receive such prior approval.

The Justice Department is demanding Texas remove the barrier at the state’s expense.

“We allege that Texas has flouted federal law by installing a barrier in the Rio Grande without obtaining the required federal authorization,” Associate Attorney General Vanita Gupta said in a statement. 

“This floating barrier poses threats to navigation and public safety and presents humanitarian concerns. Additionally, the presence of the floating barrier has prompted diplomatic protests by Mexico and risks damaging U.S. foreign policy,” the statement continued.

Joe Biden clearly does not care about protecting the nation from invasion.
