Democrats waged lawfare against Donald Trump ahead of the 2024 election.

But in her zeal to pursue Trump, this one Democrat prosecutor overstepped her bounds.

And now CNN broke the big news that Donald Trump can score this major win in court.

Former Donald Trump chief of staff Mark Meadows filed a motion in court to have his charges moved from deep-Blue Fulton County, Georgia, to federal court.

Fulton County Democrat District Attorney Fani Willis indicted Meadows, Donald Trump, and 17 others on a Constitutionally dubious racketeering charge for simply challenging the results of the 2020 election.

But even CNN legal analyst and former federal prosecutor Ellie Honig admitted that the motion filed by Meadows – which Trump as well as several other administration officials are likely to follow – has merit and could succeed.

The Supremacy Clause of the Constitution shields federal officials from facing criminal charges at the state level if they were acting in their capacity as federal officials.

Honig said this provides a strong argument for Meadows and eventually Trump to get their case moved to a federal court and eventually win an acquittal.

“So Meadows, Jeffrey Clark, and probably at some point, Donald Trump, will argue ‘we were federal officials acting within the scope of our federal jobs, therefore, the case should be moved over to federal court.’ That will be heard, it’s in the process of being heard and decided by the federal court. It will take weeks,” Honig stated.

Honig said Meadows can easily argue that Willis charged him for performing routine office duties, telling CNN viewers that he “will say ‘as Chief of Staff, what am I doing here? I’m arranging meetings, I’m arranging phone calls, I’m visiting the states. I’m doing what the President tells me to do.’”

Moving the case to federal court takes the case out of Fulton County, where the jury pool is 75 percent Democrat, to a federal court where jurors will get pulled from the entire state.

Democrats want the case in Fulton County because they know an all-Democrat jury will provide a slam dunk conviction.

A fair trial heard by a fair jury outside of the most heavily Democrat strongholds in America is a big problem for the Left.

That’s because the indictments brought against Trump and others are all based on novel legal theories that only sound strong when prosecutors can lay out their most slanted version of the facts.

But the charges crumble after facing even the slightest scrutiny and questioning.
