Jack Smith is ready for war after a Democrat judge launched this Hail Mary

Jack Smith wants to complete his mission of putting Donald Trump on trial before the election. 

He thought his window to pull it off was closed. 

But now Jack Smith is ready for war after a Democrat judge launched this Hail Mary. 

Democrat judge rushes to get Trump case moving 

Special Counsel Jack Smith’s criminal case against former President Donald Trump over January 6 was hit with numerous setbacks this year.

The Supreme Court’s ruling in Fischer v U.S. rejected the attempt by Smith and other federal prosecutors to stretch the definition of obstructing an official proceeding – which was meant to cover the destruction of financial documents – to cover the January 6 defendants.

Two of the four felonies that Smith charged Trump with in the January 6 case were obstructing an official proceeding and conspiracy to do so.

The Supreme Court dealt Smith another setback by ruling in favor of Trump in his Presidential immunity claim.

Smith was thrown a lifeline by Washington, D.C. District Court Judge Tonya Chutkan – who was appointed by former President Barack Obama – to get the January case restarted.

The case is back in her hands after the Presidential immunity ruling and she had a hearing set up within two days.

Complex criminal cases like this normally take years to work their way through the legal system.

Chutkan is raising the eyebrows of legal experts because of how fast she’s moving. 

Democrat judge wants to put Trump on trial before the election 

“Criminal cases usually never move this quickly, especially something of this complexity,” South Texas College of Law Houston professor Josh Blackman told the Washington Examiner.

Chutkan had to wait one month after the Supreme Court’s July 1 ruling in the Presidential immunity case before it was back in her court.

She was ready to hit the ground running as soon as the case landed back in her lap.

Blackman thought that Chutkan was preparing for “weeks” in order to restart it at the first possible opportunity.

“She was just sitting, waiting for the mandate to come, and she acted right away,” Blackman said. “She wants to move as quickly as humanly possible.”

He said that Smith and Chutkan were moving heaven and earth to start the trial before the election.

The Supreme Court’s ruling in favor of Trump on Presidential immunity puts Smith in a bind.

Some of Trump’s activity in the January 6 case is covered by immunity.

Smith could drop some of the charges and go with a slimmer case by filing a superseding indictment over his original one.

Left-wing legal analysts are hoping that he’ll go for a mini-trial that won’t conclude by Election Day but could tie Trump down in a courtroom and keep him off the campaign trail.

Blackman thought that Chutkan was considering at least the possibility of doing it.

“I think what she’s wrestling with is whether to go forward with a more skinny trial, just some of the claims, versus the entire kit and caboodle,” Blackman said.

Jack Smith is desperate to get one last swing of the bat against Donald Trump before Election Day.
