Controversial Attorney General Merrick Garland handpicked Jack Smith as Special Counsel for a reason.
Garland knew Smith was the type of fanatical prosecutor who will stop at nothing to bring the most devastating politically motivated indictment possible against Trump.
Smith followed through with a 37-count indictment in the Mara-Lago document ownership dispute case that has Trump looking at 400 years behind bars.
But polls show the public believes these charges are based on politics.
And Smith was forced to file the case in Florida in front of a skeptical judge and where the jury pool is made up of a majority of Trump voters.
That’s why Smith and the Biden Justice Department have a backup plan in mind to leverage the courts to take out Trump.
Smith is reportedly working on a new 45-count indictment against Trump that likely focuses on him contesting the results of the 2020 election.
“The team of federal prosecutors working under Special Counsel Jack Smith is currently prepared to add an ‘additional 30 to 45 charges’ in addition to the 37-count indictment brought against Mr. Trump on 8 June, either in a superseding indictment in the same Florida court or in a different federal judicial district. In either case, they would do so using evidence against the ex-president that has not yet been publicly acknowledged by the department, including other recordings prosecutors have obtained which reveal Mr. Trump making incriminating statements,” the Independent exclusively reported.
Smith reportedly flipped Trump campaign aide Mike Roman, who is now cooperating with the investigation.
Charges for January 6 would reportedly focus on fraud and seditious conspiracy.
If Smith brings these charges, he would be following novel legal theories and engaging in what some legal experts believe is ordinary political activism.
Democrats protested and contested the results of every Presidential election won by Republicans since 1988, yet no one faced criminal charges.
But Smith is a prosecutor with a reputation for zealously pursuing Republicans and stretching the law past the limit to do so.
In 2016, a unanimous 8-0 vote by the Supreme Court threw out Smith’s conviction of former Republican Governor Bob McDonnell after the Justices ruled that he used far too wide an interpretation of a corruption statute.
If Smith brings an indictment against Trump for January 6, it would be in Washington, D.C., where he would likely count on an Obama judge overseeing the case and a jury pool of Joe Biden voters.
The outcome would be decided and Trump’s guilt assured merely because of where the case was tried.
And an Obama judge would likely allow Smith to try the case before the 2024 election, meaning he could have a left-wing jury convict Trump in short, which would tank the election for Republicans and hand Joe Biden a second term.
